And I found one person to say: 函送法办仅是警方用信函方式,将警方所认为施明德等人违法的事证,寄送检察官处由检 察官视警 方所提供的事证及自己搜集的事证提起对施明德等人的诉讼。 通常警方认定有违法的事情,检察 官不一定也认为该案有违法,以微罪不举的原则处理。 but another says succinctly: 送到监狱！ This very official site: http://www.4pppc.gov.tw/web_4/modules/news/index.php?storytopic=0&storynum=25 uses repeatedly 移（函）送法辦 like another site which has: 犯罪嫌疑人移（函）送法辦者，移（函）送單位於發文移（函）送翌日起幾日內，將該移（函） 送（報告）書電子檔上傳內政部警政署刑事警察局？(A)半日(B)... And on the other hand, I find many examples like 警方将她函送法办。 which seem to imply that the person was physically arrested.
